Terms and Conditions for DayZ Modding Services & Commissions

These Terms and Conditions govern the commissioning of custom DayZ mods and related services provided by Mirasaki Development. By commissioning us for custom software, mods, or assets, you agree to comply with and be bound by the following terms.

Scope of Services
- Our services encompass the development and customization of DayZ mods, scripts, and other related software solutions tailored to your specific server setup. The scope of work, including timelines, pricing, and revision limits, will be defined and agreed upon before the commencement of each project.
- While we will assist in adding items to your traders (any trader/market mods), you acknowledge and agree that you are responsible for setting and adjusting the buy and sell prices for your own items. As it is not feasible for us to determine your desired pricing for each item, any pricing adjustments must be made by you directly.
Client Responsibilities
To ensure the successful delivery of custom mods or services, you, the client, are responsible for providing accurate and complete information about your server environment. This includes, but is not limited to:
Server Configuration
- For Omega Manager enabled servers, you must upload the
omega.cfg
file. - For GTX and Nitrado servers, you must provide a full export or screenshot of the
Workshop.mods
file/section.
Modifications
- A comprehensive list of all mods currently active on your server, including custom scripts, repacked and/or third-party assets.
Server Environment
- Detailed documentation of your server environment, including performance data, hardware specifications, and known constraints.
Relevant Logs and Files
- Any log files, error reports, or other diagnostics that could assist in troubleshooting or ensuring mod compatibility.
Failure to provide this information may result in incompatibility issues for which we cannot be held responsible.
Compatibility Limitations
We will make every effort to ensure our custom mods function as intended within your described server environment. However, compatibility with all mods, configurations, or future server changes is not guaranteed unless specifically discussed and agreed upon prior to the start of the project.
- If key information is omitted or not provided, it is understood that:
- We are not liable for incompatibility issues.
- Any necessary fixes, adjustments, or further customizations required due to these omissions will be treated as a separate service and may incur additional costs.
Project Delivery and Revisions
- Estimated project completion times will be defined in the project proposal. Delays in receiving required information from you may result in extended timelines, for which we are not responsible.
- A limited number of revisions will be provided as outlined in the project scope. Additional revisions beyond this scope will be considered as separate work and will be billed accordingly.
Support and Post-Delivery
We offer a limited post-delivery support window, typically for 30 days, to address any bugs or issues directly related to the custom work. This support does not cover:
- Issues arising from modifications to the server configuration after delivery.
- New mods, configurations, or scripts added to the server post-delivery that were not part of the original scope.
- Problems caused by incorrect or incomplete information provided by the client at the project's outset.
Any further work required due to these factors will be considered a new commission and charged accordingly.
Pricing and Payments
- Any changes or additional features requested after the initial project scope has been agreed upon will incur extra costs, which will be communicated to you in advance.
- Failure to complete payments within the agreed-upon terms may result in the withholding of project files and suspension of further services until the balance is settled.
Liability
We strive to ensure that our custom DayZ mods meet your expectations and function as requested. However, we cannot be held liable for:
- Server downtime, bugs, crashes, or data loss caused by third-party mods or server configurations not covered under the original project scope.
- Incompatibility issues resulting from failure to provide full and accurate information about your server setup.
- Future changes to DayZ game updates or third-party mods that may render the commissioned work incompatible after project delivery.
Termination of Services
We reserve the right to terminate any project if the client fails to provide the necessary information or fails to make timely payments. Any work completed up to the point of termination will remain payable and will not be refunded.
Intellectual Property
Upon final payment, you will own the rights to the custom mod or assets developed for your server. However, we retain the right to use elements of the work for promotional or portfolio purposes unless a prior agreement is made to restrict this.
Agreement
By commissioning us for custom DayZ mods or services, you acknowledge that you have read, understood, and agree to these Terms and Conditions. Failure to comply with these terms may result in the inability to deliver or support your custom DayZ mods, assets, or services.
Governing Law
These Terms and Conditions are governed by the laws of the Netherlands.
